Tardive dyskinesia is characterized by constant, uncontrollable actions of the mouth, tongue, jaw, cheeks, arms, legs, and hips. Tardive dyskinesia can affect anyone, including infants, some of whom are prescribed Reglan because it helps them spit-up less often.
Symptoms of tardive dyskinesia include repetitive and purposeless movements, such as continual chewing, grimacing, sticking the tongue in and out, smacking the gums, pursing the lips, rapid blinking, rapid arm and leg movements, and facial distortions.

Reglan has been on the market since 1985, but it only received its black box warning—the strongest warning the Food and Drug Administration (FDA) can give—in 2009, 14 years after it was released on the market. More than 2 million Americans use metoclopramide drugs.

What Is the Legal Issue with Reglan?
One major legal issue associated with Reglan use is “failure to warn.” Because it has been known since the 1980s that Reglan was linked to tardive dyskinesia, the company should have warned users long before 2009 of the drug’s dangers. This is called “failure to warn.”
When a company with a potentially dangerous product fails to warn users of its dangers, they must be held liable for their negligence. Metoclopramide-containing drugs should have had clear, obvious warnings about its side effects, and those risks should have been known to doctors prescribing the drug. Those risks should also have been abundantly clear to people taking metoclopramide so they could weigh the risks versus benefits for themselves.
Most tardive dyskinesia sufferers were not aware that the drug they were prescribed for heartburn or nausea could wreak havoc in their lives, nor did mothers know that their infants who were prescribed Reglan could suffer permanent movement disorders that would prevent them from ever living a normal life.
Are Reglan Lawsuits Being Filed?
Yes. Reglan lawsuits are currently being filed across the country. The lawsuits center around the manufacturer failing to warn of the link between Reglan use and the development of tardive dyskinesia in infants and adults. Many lawsuits allege that the manufacturers of Reglan were well aware of the risk of tardive dyskinesia—and have been aware of the link for more than 20 years—but didn’t disclose that fact to the proper regulatory authorities such as the Food and Drug Administration.
